Notomo Terms of Use

1. Acceptance of Terms

By creating an account, accessing, or using Notomo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use Notomo.

2. Eligibility

You must have a valid Google account and the legal capacity to enter into these Terms. If you use Notomo on behalf of an organization, you represent that you have the authority to bind that entity.

3. User Responsibilities

3.1 Compliance

• You are solely responsible for ensuring your use of Notomo complies with all applicable local, institutional, and national laws, including those regarding recording, privacy, and intellectual property.
• You must not use Notomo for any unlawful, harmful, or unauthorized purpose.

3.2 Institutional and Copyright Policies

• Do not record, upload, or share any content in violation of your school, workplace, or organization's policies.
• Do not upload or share copyrighted material without explicit permission from the copyright holder.

3.3 Privacy

Do not record or share private or confidential communications without the consent of all parties, as required by law.

4. License and Intellectual Property

• Codeiku grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Notomo for personal, non-commercial purposes.
• All intellectual property rights in Notomo and its content remain with Codeiku or its licensors.
• You may not copy, modify, distribute, reverse engineer, or create derivative works from Notomo without our written consent.

5. Prohibited Conduct

You agree not to:

• Violate any law, regulation, or third-party right.
• Use Notomo for commercial purposes without our consent.
• Access Notomo using automated means (bots, scripts, scraping, etc.).
• Attempt to gain unauthorized access to Notomo or its systems.
• Transmit malware or other harmful code.
• Harass, threaten, or abuse others.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

7. No Refund Policy

All purchases, subscriptions, and payments made through Notomo are final and non-refundable. By using Notomo and making a purchase, you acknowledge and agree that you are not entitled to any refund, except where required by applicable law.

8. Termination

We reserve the right to suspend or terminate your account and access to Notomo at our discretion, including for violation of these Terms or applicable laws. Upon termination, your license to use Notomo ends immediately.

9. Disclaimers

• Notomo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free service, or that Notomo will meet your needs.
• We are not responsible for user-generated content or actions.

10. Limitation of Liability

To the maximum extent permitted by law, Codeiku and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of Notomo. Our total liability for any claim relating to Notomo will not exceed the amount paid by you to us in the past 12 months.

11. Indemnification

You agree to indemnify and hold harmless Codeiku, its affiliates, and employees from any claims, damages, losses, or expenses arising from your use of Notomo, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications

We may update these Terms at any time. We will notify you of significant changes via the App or email. Continued use of Notomo after changes means you accept the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. Any disputes shall be resolved exclusively in the courts of Zagreb, Croatia.
